The Rulings of Funerals and Burial during the time of Covid-19 Pandemic

Dear brothers and sisters,
In response to inquiries received, his eminence Sheikh dr Abdullah AlJudai' read this Fatwa about the Rulings of Funerals and Burial which was sent to him by our brothers in Italy and approved it. We ask Allah SWT safety for all:

"In the Name of Allah, the Most Beneficent, the Most Merciful

The Rulings of Funerals and Burial during the time of Covid-19 Pandemic

These days, many questions have been raised regarding the funerals and its rulings during this critical situation, especially with the death of Muslims in several countries (may Allah have mercy upon them). The questions are in regards to washing the person affected by this epidemic Corona Virus, and shrouding him/her, Salatul Janazah and the burials.

While having the fear of infection from the dead to the neighborhood, according to what doctors say, laws and precautions regarding gatherings that do not allow gathering to perform funeral prayers with certain numbers, the laws and medical precautions of burying such bodies that died by epidemic diseases such as this virus and the limitation of the number of the graves for Muslims throughout western countries, are making specific and special rulings when dealing with these issues according to the rules of Islam.

Based on all of the above, and with an emphasis on the need to adhere to the laws and instructions issued by the country and the concerned authorities, we summarize the answer to the funeral questions as follows:

1- With regard to washing the deceased from those afflicted with this disease, it is sufficient, if it is not permitted or accessible to wash it, or the transmission of the disease is feared, then it is to wash it by pouring water on it from a distance while taking the necessary precautions for washing. If this is not possible, then Tayammum for the deceased will be sufficient, otherwise it can be buried without washing and/or without Tayammum in case the transmition of the infection would happen in either way. This is because the safety of the living individul is more priority than the dead, and because protecting the living from a high probability of catching this epidemic is more important than to wash the dead, which, even if originally, is a duty, except that there is no taklif (obligation) except with the ability, Allah the Almighty said: (Allah does not burden any soul beyond its scope).

These are the rulings regarding the order of the steps that the jurists have mentioned in case it is impossible to wash the dead.

2- The deceased is to be shrouded in the Islamic shroud, if possible. Otherwise, a garment will be wrapped on him on his garments in which he died if available, otherwise he will shroud his garments in which he died.

3- Praying Janazah for the dead is Fard Kifayah (collective obligation) - as is well known - the performance of which is sought from the mukallafin (those who are Islamically obliged to do) collectively, but not from every individual specifically.

And if some Muslims (such as the family, the relatives or the friends of the deceased) were able to receive the dead body of the deceased and pray Janazah for him/her, then it will be sufficient and it is not becoming an obligation upon the rest of the Muslims. It is sufficient that the Janazah prayer, in these circumstances, will be established by two or three Muslims.

It is also permissible for any Muslim who couldn't be able/was not allowed to be present with the deceased, then in this case they can pray Salatul Gha'eb (the prayer for the absent) in congregation or individually. The deceased in these circumstances is in the ruling of the distant dead, that we can pray for him/her Salatul Gha'eb which is the mazhab of Shafi’i and Hanbali and some Maliki.

4- As for the burial, the basic principle is that a Muslim will be buried in the graves of Muslims. If it is not available, he/she will be buried wherever possible, even in the tombs of the non-Muslims)

(The jurists agreed that it is not allowed to bury a Muslim in the cemetery of the non-Muslims, unless necessary).

The European Fatwa Council has issued a ruling that burial in non-Muslim cemeteries is permissible when there are no Muslim cemeteries.

It is recommended to all Muslims in these circumstances and if it was impossible for them to attend the funerals, that they make duaa for those who died, and they should continue to do so, and also to pray upon the deceased Salatul Gha'eb. It is also to make a lot of Duaa for the sick to heal and to lift the scourge from the whole world.

اليكم نص الفتوى:

"بسم الله الرحمن الرحيم

أحكام الجنائز والدفن في ظل مستجدات وباء كورونا

الحمد لله والصلاة والسلام على رسول الله.

وبعد:

فإنه لا يخفى على أحدٍ ما أصاب العالمَ من جَرَّاء انتشار وباء (فيروس كورونا الجديد) وإيطاليا على وجه الخصوص التي تُعدُّ أكثر بلد بعد الصين من حيث انتشار المرض؛ حيث تتزايد حالات الإصابة يومياً بشكل ملحوظ، متجاوزة (35,000 حالة) ضاقت بها المستشفيات، كما ارتفعت حالات الوفاة؛ حيث تقارب (3,000 حالة)، وما ترتب على ذلك من قوانين استثنائية ضرورية للحدِّ منه، أدَّت إلى شبه تعطيل للحياة، ومعها عُلِّقت صلوات الجماعة والجمعة، وأغلقت المساجد والكنائس وغيرها، كما أُغلقت الأجواء، وقيِّدت حركة التنقل الداخلي إلا من الضروري منها، وعُطِّلت المدارس، والجامعات، وكثير من الوظائف، ما جعل البلاد في حالة ضرورة استثنائية، فرضت تغيُّراً في كل جوانب الحياة.

والفتوى - كما هو معلوم - تتغير بتغير الزمان والمكان والظروف والأحوال، وقد تقرر في فقهنا الإسلامي جملةٌ من القواعد التي تراعي مثل هذه الظروف، ومنها:

(الضرورات تبيح المحظورات)

(المشقة تجلب التيسير)

(لا تكليف إلا بمقدور)

(لا واجب مع العجز)

(الميسور لا يسقط بالمعسور)

وكل هذه القواعد وما تفرع عنها، إنما بُنيتْ على استقراء نصوص الوحي، وروح الشريعة،

ومن ذلك قول الله تعالى: (لاَ يُكَلِّفُ اللَّهُ نَفْسًا إِلاَّ وُسْعَهَا)

وقوله تعالى: (لا يُكَلِّفُ اللَّهُ نَفْسًا إِلاَّ مَا آتَاهَا)

وقوله: (وَمَا جَعَلَ عَلَيْكُمْ فِي الدِّينِ مِنْ حَرَجٍ).

وقوله: (يُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَ).

وقوله صلى الله عليه وسلم: (يَسِّرُوا وَلا تُعَسِّرُوا)

وغير ذلك من النصوص الكثيرة.

وقد كثرت الأسئلة هذه الأيام في باب الجنائز وأحكامها في ظل هذا الوضع الحرج، وخاصة مع وفاة أول مجموعة من المسلمين في إيطاليا - رحمة الله تغشاهم - كغسل المصاب بهذا الوباء، وتكفينه، والصلاة عليه، ودفنه.

وفي ظل الخشية من انتقال العدوى من الميت إلى الحي بحسب ما يقول الأطباء، وقوانين منع التجمعات التي لا تسمح بالتجمع لإقامة صلاة الجنائز، وغلق الأجواء أمام السفر ما يجعل نقل الجثث إلى البلد الأصلي لمن يرغبون متعذراً، وقلة المقابر الخاصة بالمسلمين في عموم إيطاليا، وحتى تلك المقابر القائمة فإنها عادة ما تكون خاصة بالمقيمين رسمياً في تلك المدن، ما يصعب معه نقل جثة من مدينة لأخرى.

وبناء على كل ما سبق، ومع التأكيد على ضرورة الالتزام بالقوانين والتعليمات الصادرة عن الدولة والجهات المعنية، فإننا نلخص الجواب على الأسئلة المتعلقة بالجنائز بالآتي:

أولاً: بالنسبة لغسل المتوفى من المصابين بهذا المرض، فإنه يكفي - إذا لم يُسمح بغسله، أو خُشي انتقال العدوى – غسله بصبِّ بالماء عليه من بعيد، مع أخذ الاحتياطات اللازمة للمغسلين، فإن تعذَّر ذلك يُمِّمَ، وإلّا دُفن دون غسل ولا تيمم دفعاً لانتقال العدوى، وذلك لأن الحي أولى من الميت، ولأن حماية الأحياء من احتمالية كبيرة بالإصابة بهذا الوباء أولى من الحرص على غسل الميت، الذي وإن كان في الأصل واجباً، إلا أنه لا تكليف إلا بمقدور، قال تعالى: (لا يكلف الله نفساً إلا وسعها)

وبهذا الترتيب قال فقهاء المذاهب في حال تعذر غسل الميت.

ثانياً: يُكفَّن الميِّت بالكفن الشرعي إن تيسر ذلك، وإلا فَيُلفُّ عليه ثوب على ثيابه التي مات فيها إن تيسَّر، وإلا فكفنه ثيابه التي توفي فيها.

ثالثاً: الصلاة على الميت فرض كفاية -كما هو معلوم- إذا قام بها البعض سقط وجوبها عن بقية المكلفين.

وإذا تمكن بعض المسلمين من استلام جثة المتوفى والصلاة عليه، أجزأ ذلك وسقط الوجوب عن بقية المسلمين. ويكفي أن يصلي عليه ثلاثة أو اثنان، بل ذهب بعض العلماء إلى أن الوجوب يسقط بصلاة المكلف من الرجال، كما هو عند الشافعية والحنابلة.

ويمكن لمن شاء من المسلمين أن يصلي عليه صلاة الغائب، جماعةً -كأن تصلى في البيوت- أو فرادى، فقد ذكر بعض الشافعية والحنابلة جواز الصلاة على الميت (صلاة الغائب) إذا شق حضور الصلاة عليه، والصلاة في هذه الحالة من باب أولى، لتعذر الحضور، كما أن المتوفى في هذه الظروف في حكم الميت البعيد؛ الذي تجوز الصلاة عليه عند الكثير من العلماء، وهو مذهب الشافعية والحنابلة وبعض المالكية.

ثالثا: أما الدفن، فإن الأصل فيه أن يدفن المسلم في المكان الذي يموت فيه، فقد دفن الصحابة رضي الله عنهم في الأماكن التي ماتوا فيها.

والأصل كذلك أن يدفن المسلم في المقابر الخاصة بالمسلمين؛ فإن لم يتيسر؛ فيدفن حيث أمكن ولو في مقابر غير المسلمين، إذ لا يكلف الله نفساً إلا وسعها، ولا يضر المسلم في حالة كهذه أن يدفن في مقابر غير المسلمين، فإن الذي ينفعه في آخرته هو عمله وليس موضع دفنه، قال تعالى: (وأن ليس للإنسان إلا ما سعى). وكما قال سلمان رضي الله عنه: (الأرض لا تقدس أحداً).

ونحن في ظرفٍ صار الدفن في هذه المقابر ضرورة لا تخفى على أحد، والضرورات تبيح المحظورات.

وقد جاء في الموسوعة الفقهية الكويتية (21/19): (اتفق الفقهاء على أنه يحرم دفن مسلم في مقبرة غير المسلمين، وعكسه، إلا لضرورة).

وقد أفتى مجلس الإفتاء الأوروبي بجواز الدفن في مقابر غير المسلمين عند عدم وجود المقابر الخاصة بالمسلمين.

هذا.. ونوصي عموم المسلمين في هذه الظروف - وقد تعذر معها الاجتماع على الجنائز - بأن يكثروا من الدعاء لمن مات، وأن يتواصوا على ذلك، وعلى الصلاة عليه صلاة الغائب في البيوت، وأن يكثروا من الدعاء للمرضى بالشفاء، وبرفع البلاء عن إيطاليا، وكل بلاد الدنيا.
